We use or may use analytics and advertising services to understand our customers, measure performance, advertise LYCKD, and improve our Services.

These services may include technologies and services provided by platforms such as Meta, Google, TikTok, Shopify, and other advertising or analytics providers.

For example, we may use the Meta Pixel, Meta Conversions API, or similar technologies to understand interactions with our website, measure conversions, create or refine advertising audiences, and deliver advertisements that may be more relevant to users.

We may similarly use Google Analytics, Google advertising technologies, TikTok advertising technologies, or comparable services now or in the future.

Advertising providers may process information concerning your interactions with LYCKD, our Services, our advertisements, and other websites or services in order to measure advertising and, where permitted, personalize or target advertisements.

Depending on applicable privacy law, certain disclosures of personal information to advertising partners may be legally considered a “sale,” “sharing,” or use for “targeted advertising,” even when no money is exchanged for your personal information.

Where applicable law provides you with the right to opt out of the sale or sharing of personal information or the processing of personal information for targeted advertising, you may exercise that right through our Data Sharing Opt-Out page.

Your opt-out rights and how they apply may vary depending on where you reside.

How We Disclose Personal Information

We may disclose personal information to the following categories of recipients.

Shopify

Our store is powered by Shopify. Shopify collects and processes personal information about your access to and use of the Services in order to provide, support, protect, and improve the Services.

Information you submit through the Services may be transmitted to and processed by Shopify and service providers that may be located in countries other than where you reside.

To help protect, grow, and improve our business, we use certain Shopify enhanced features, including Shopify Network Intelligence, that incorporate data and information obtained from your interactions with our store, along with your interactions with Shopify and other merchants.

To provide these enhanced features, Shopify may use personal information collected about your interactions with our store, other merchants, and Shopify. In connection with these enhanced features, Shopify is responsible for certain processing of your personal information, including responding to requests to exercise your rights regarding Shopify's use of your personal information for these purposes.

To learn more about how Shopify processes personal information, please review Shopify's Consumer Privacy Policy. Depending on where you live, you may also exercise certain rights regarding Shopify's processing of your personal information through Shopify's Privacy Portal.

Service Providers

We may disclose personal information to vendors and service providers that help us operate our business, such as providers of:

  • ecommerce and website services;

  • order fulfillment;
  • shipping and logistics;
  • subscription management;
  • email delivery;
  • SMS messaging;
  • customer support;
  • telephone services;

  • professional and administrative services.

These providers may process personal information as necessary to provide their services to us or as otherwise permitted by applicable law.

Advertising and Analytics Partners

We may disclose or make information available to advertising, social media, and analytics providers, including through cookies, pixels, APIs, and similar technologies.

These parties may use information to measure advertising, understand audience activity, provide analytics, create advertising audiences, or deliver targeted or personalized advertising where permitted.

Professional Advisors

We may disclose information where reasonably necessary to lawyers, accountants, auditors, consultants, insurers, financial institutions, and other professional advisors.

Government Authorities and Legal Recipients

We may disclose personal information when reasonably necessary to comply with applicable law, regulation, legal process, court order, governmental request, or other legal obligation, or to protect our rights or the rights and safety of others.

Business Transactions

If Selectra Labs Inc., LYCKD, or relevant business assets are involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar business transaction, personal information may be disclosed or transferred as part of that transaction, subject to applicable law.

At Your Direction

We may disclose information when you direct or authorize us to do so.

Sale, Sharing, and Targeted Advertising

LYCKD does not sell personal information for money.

However, certain privacy laws define “sale” or “sharing” broadly enough that our use of advertising, analytics, cookies, pixels, Shopify enhanced services, or similar technologies may constitute a sale or sharing of personal information or processing for targeted advertising.

Where applicable law provides you with the right to opt out of the sale or sharing of personal information or the processing of personal information for targeted advertising, you may exercise that right through our Data Sharing Opt-Out page.

Your opt-out rights and how they apply may vary depending on where you reside.

Email and SMS Marketing

If you choose to receive marketing communications from us, we may send promotional messages by email or SMS in accordance with applicable law.

You may unsubscribe from marketing emails by using the unsubscribe link included in those communications.

You may opt out of marketing SMS messages by replying STOP or using another opt-out method provided in the applicable message.

We may use third-party email and SMS providers to facilitate these communications. These providers may process your contact information, messaging preferences, message activity, and related information on our behalf.

Opting out of marketing communications does not prevent us from sending non-marketing communications when appropriate, such as order confirmations, shipping notices, subscription information, account notices, security messages, or other transactional and administrative communications.

Additional terms may apply to participation in our SMS marketing program.

Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected or otherwise processed.

The appropriate retention period may depend on factors including:

  • how long we have an ongoing relationship with you;
  • whether you maintain an account or active subscription;
  • the purposes for which the information was collected;
  • applicable legal, tax, accounting, or regulatory requirements;
  • fraud prevention and security needs;
  • applicable limitation periods;
  • dispute resolution; and
  • establishing, exercising, or defending legal claims.

Different categories of personal information may therefore be retained for different periods.

When personal information is no longer reasonably necessary for the purposes for which it is retained, we may delete, anonymize, or otherwise dispose of it, subject to applicable law.

Security

We use reasonable administrative, organizational, and technical safeguards designed to protect personal information.

However, no method of transmitting information over the Internet or storing information electronically can be guaranteed to be completely secure.

You are responsible for maintaining the confidentiality of information associated with your account and for taking reasonable precautions when accessing your account or communicating sensitive information.

If you believe your interaction with us or your account is no longer secure, please contact us.

Your Choices

Email

You may opt out of marketing emails by following the unsubscribe instructions included in the message.

SMS

You may opt out of marketing SMS messages by replying STOP or following another provided opt-out mechanism.

Advertising and Data Sharing

Where applicable, you may use our data-sharing opt-out page or other privacy controls to opt out of certain sale, sharing, or targeted advertising activities.

Account Information

Where available, you may review or update certain information through your customer account.

You may also contact us regarding your personal information at privacy@lyckd.com.

Global Privacy Control

Where applicable, if you visit our website with the Global Privacy Control (“GPC”) opt-out preference signal enabled, we will automatically treat the signal as a request to opt out of applicable sale or sharing of personal information or processing for targeted advertising for the device and browser you use to visit our website.

If Shopify is able to associate the device sending the GPC signal with a Shopify account, the opt-out request may also be applied to that account.

Because GPC generally operates at the browser or device level, you may need to exercise your choice separately on other browsers or devices.

Other than Global Privacy Control, we do not currently recognize other “Do Not Track” signals that may be sent from your browser or device.

U.S. Consumer Privacy Rights

Depending on your state of residence and subject to applicable law, you may have certain rights regarding your personal information.

These rights may include the right to:

  1. Access or Know — request confirmation of whether we process personal information about you and request access to certain personal information.
  2. Correct — request correction of inaccurate personal information.
  3. Delete — request deletion of certain personal information we maintain about you.

  9. Non-Discrimination — exercise applicable privacy rights without unlawful discrimination or retaliation.

The precise rights available to you vary depending on your jurisdiction and whether the applicable privacy law applies to LYCKD and the relevant processing activity.

Submitting a Privacy Request

To exercise an applicable privacy right, you may:

Please describe the right you wish to exercise and provide sufficient information for us to identify the relevant records and respond to your request.

Rights relating specifically to personal information processed by Shopify for Shopify's own purposes or enhanced services may also be exercised through Shopify's Privacy Portal.

Verification

We may need to verify your identity before completing certain privacy requests.

The information required for verification will depend on the nature and sensitivity of the request. We will only request information reasonably necessary to verify the request and protect personal information from unauthorized access or deletion.

We may deny or limit a request where permitted by applicable law, including where we cannot reasonably verify the request or an applicable exception applies.

Authorized Agents

Where permitted by applicable law, an authorized agent may submit certain privacy requests on your behalf.

We may require reasonable evidence that the agent is authorized to act for you and may also require you to verify your identity or confirm the authorization directly.

Appeals

If applicable law provides a right to appeal and we decline to take action on your privacy request, you may appeal our decision by contacting privacy@lyckd.com and stating that you are appealing a privacy request decision.

California Residents

If you are a California resident and applicable California privacy law applies to our processing of your information, you may have additional rights regarding the categories and sources of personal information we collect, the purposes for which it is collected or disclosed, the categories of recipients to whom it is disclosed, and applicable sale or sharing of personal information.

  • internet or other electronic network activity;

We use and disclose these categories for the purposes described in How We Use Personal Information and How We Disclose Personal Information above.

We do not knowingly sell or share personal information of consumers under 16 years of age for targeted advertising.

Complaints

If you have a complaint or concern about how we collect, use, disclose, or otherwise process your personal information, please contact us at privacy@lyckd.com.

We will review and respond to privacy complaints in accordance with applicable law.

Depending on where you reside, you may also have the right to appeal a decision we make regarding a privacy request or submit a complaint to an applicable privacy or data protection authority.

Sensitive Personal Information

Certain information processed in connection with our Services may qualify as “sensitive personal information” under applicable privacy laws, such as account login credentials or certain payment-related information.

We use sensitive personal information only for purposes reasonably necessary to provide our Services, process transactions, maintain accounts, protect security and integrity, prevent fraud, comply with law, and for other purposes permitted by applicable law.

Unless specifically requested, please do not provide us with unnecessary sensitive information such as Social Security numbers, medical records, detailed health information, government identification numbers, information about racial or ethnic origin, political opinions, religious beliefs, or other highly sensitive information through ordinary customer service communications.

If we learn that we have collected personal information from a child under 13 in circumstances prohibited by applicable law, we will take reasonable steps to delete the information.

If you believe a child under 13 has provided personal information to us, please contact us at privacy@lyckd.com.

International and Cross-Border Processing

Selectra Labs Inc. is based in Canada, while LYCKD currently offers its products to customers in the United States.

Your personal information may be processed, transferred, or stored in Canada, the United States, and other countries where we, Shopify, or our service providers operate.

Privacy and data protection laws in those jurisdictions may differ from those in your state, province, or country of residence.

Where required by applicable law, we take appropriate steps relating to cross-border processing and transfers of personal information.

Third-Party Websites and Services

Our Services may contain links to third-party websites, applications, social media platforms, or services.

This Privacy Policy does not govern the privacy practices of third parties that independently control how they collect and process information.

We encourage you to review the privacy policies of third-party services before providing information to them.

Business Transfers

If all or part of Selectra Labs Inc., LYCKD, or our assets are involved in a merger, acquisition, financing, reorganization, sale, bankruptcy, or similar transaction, personal information may be disclosed or transferred as part of that transaction.

Any recipient will be subject to applicable legal requirements concerning the personal information transferred.
